SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AND WHO ARE PHYSICALLY LOCATED AND RESIDE IN THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA AT THE TIME OF ENTRY.
1. HOW TO ENTER: The BIC® Razor Sweepstakes (the “Sweepstakes”) sponsored by BIC USA Inc. (the “Sponsor”) begins at 7AM CST on Thursday, June 8, 2017 and ends at 11:59PM CST on Sunday, June 11, 2017 (the “Sweepstakes Period”). The Administrator’s computer is the Sweepstakes official clock.
How to Enter: There are two (2) ways to enter the Sweepstakes:
1.Instagram: An entrant must (a) visit the BIC® Razor Instagram account at www.instagram/bicflexrazors during the Sweepstakes Period; and (b) in response to Sponsor’s post relating to the BIC Razor Sweepstakes (the “Post”), comment about how entrant has matured including the hashtag #MyBICFlex5HybridStory (an “Entry”). To participate via Instagram, an entrant must have a non-private Instagram account to enter the Sweepstakes via Instagram and maintain such non-private account for at least thirty days after the Sweepstakes Period ends to be eligible to win/claim a prize for notification purposes. An entrant may create an Instagram account at no cost at https://instagram.com. Creation of an Instagram account requires entrant to agree to Instagram’s Terms of Use and Privacy Policy, available at https://help.instagram.com/478745558852511 and https://help.instagram.com/155833707900388. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram.
2.Facebook: An entrant must, (a) visit the BIC® Razor Facebook account at www.facebook.com/bicflexrazors during the Sweepstakes Period; and (b) in response to Sponsor’s post relating to the BIC Razor Sweepstakes (the “Post”), comment about how entrant has matured including the hashtags #MyBICFlex5HybridStory (an “Entry”). To participate via Facebook, an entrant must have a non-private Facebook account to enter the Sweepstakes via Facebook and maintain such non-private account for at least thirty days after the Sweepstakes Period ends to be eligible to win/claim a prize for notification purposes. An entrant may create a Facebook account at no cost at https://Facebook.com. Creation of a Facebook account requires entrant to agree to Facebook’s Terms of Use and Privacy Policy, available at https://www.facebook.com/terms and https://www.facebook.com/policy.php. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook.
“Liking” the Post, regramming the Post, following the BIC Razor Instagram OR Facebook account does not constitute a valid Entry. Sponsor reserves the right to assess entries for validity and disqualify invalid entries. Prize Winners will be selected by random drawing from all valid entries received at the end of the Sweepstakes Period. Limit of one Entry per person regardless of method of entry. The first Entry received from an Entrant will be counted as the Entrant’s eligible Entry. You must be a registered user of Instagram or Facebook with a valid active account in order to enter the Sweepstakes. Instagram or Facebook registration is free and can be obtained by logging into www.instagram.com or www.Facebook.com and following the instructions to open an account.
If Entrants participate via a wireless phone, message and data rates may apply. Entrants should consult their wireless-service provider regarding its message and data pricing plans.
During the Sweepstakes Period, multiple entries, mass entries and entries generated by script, macro, bot or other automated means or by any means that subvert the Entry process will be void. Entries that are mechanically reproduced, copied, illegible, late or inaccurate are void. Incomplete entries or entries not complying with these Official Rules are subject to disqualification, at the Sponsor’s sole discretion. Entries will not be acknowledged or returned. Sponsor’s decisions are final on all matters relating to this Sweepstakes.
An Entry must be in keeping with the Sponsor’s image, and may not be racially, ethnically or otherwise offensive in any way, lewd, vulgar, indecent, obscene, violent or discriminatory, nor can it defame, or invade upon the publicity rights or privacy of any person or otherwise infringe upon any person or entity’s intellectual property, personal or proprietary rights, as determined by Sponsor in its sole discretion. An Entry must not contain any email addresses, phone numbers, addresses, URL’s or other forms of personal information. An Entry must not include references to other products, advertisements, “spam” content, offers or websites. Sponsor reserves the right, at its sole discretion, to delete any Entry posted that the Sponsor feels is inappropriate, objectionable and/or inconsistent with these Official Rules or the positive image and/or good will it wishes to promote in this Sweepstakes. If an Entry is deleted by Sponsor, the Entry is automatically disqualified. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, remove or dispose of any Entry and proper names, for advertising and promotional purposes in all media now or hereafter known worldwide, in perpetuity, (including, but not limited to, the internet and social networking sites) without additional compensation, notification or permission, except where prohibited by law.
By entering the Sweepstakes, entrants agree to abide and be bound by these Official Rules and the decisions of Sponsor and Administrator, which shall be final, binding, and conclusive in all respects.
All entries become the sole property of Sponsor and will not be returned or acknowledged. All Entry information will be held and used in accordance with these Official Rules located at http://www.hunterpr.com/rules/bic/0606 and the Sponsor’s Privacy Policy located at http://bicflexrazors.com/#policy.
2. ELIGIBILITY: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who are eighteen (18) years of age or older and who are physically located and reside in the fifty (50) United States and the District of Columbia at the time of Entry (“Eligible Participant”) and who are registered users of Instagram and/or Facebook with an active account. Persons in any of the following categories are NOT eligible to enter or win a prize: (a) employees or agents of BIC USA Inc., HPR Partners, LLC d/b/a Hunter Public Relations (“Hunter” or “Administrator”) , Warner Nashville, LLC, Rudy’s Barbershop Holdings, LLC, and their respective parent companies, subsidiaries, affiliates, distributors, and advertising and promotion agencies; (b) individuals engaged in the development, production or distribution of materials for the Sweepstakes; and (c) persons who are in the immediate family of any person in any of the preceding categories (including mother, father, sister, brother, daughter, son, spouse, grandparents or grandchildren), regardless of where they live; or persons who reside in the same household, whether related or not, as any person in any of the preceding categories. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law.
3. PRIZE: Five (5) Prize Winners will be randomly selected from all valid entries received at the end of the Sweepstakes Period. Prize winners will each receive one (1) $150 Amazon gift card, one (1) stainless steel bar set ($59.95) and two (2) packages of BIC® Flex5™ Hybrid razors ($7.99 each). Approximate Retail Value (“ARV”): $225.93.
Total ARV of all Prizes: $1,129.65.
All federal, state and local taxes, and any other costs and expenses associated with the receipt or use of the Prize are the sole responsibility of the Prize Winner.
GENERAL PRIZE CONDITIONS/RESTRICTIONS: Brand owners of products awarded as prizes (other than Sponsor) are not associated with the Sponsor of this Sweepstakes. Prizes are awarded “as is” with no warranty or guarantee, either express or implied, are subject to the manufacturers’ terms and conditions, and Prize Winners agree to look solely to such manufacturers for any such warranty or guarantee claim. Prizes cannot be sold, bartered or transferred in whole or in part, or substituted or redeemed for cash by Prize Winner. Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion in the event of unavailability. Winners are responsible for federal, state and local taxes as well as any costs and expenses associated with prize acceptance. All prize details are at Sponsor’s sole discretion.
4. SWEEPSTAKES ENTRIES: Entries become the property of Sponsor and will not be acknowledged. In the event of a dispute concerning the identity of an entrant, the authorized account holder of the Instagram or Facebook account submitted at time of Entry will be deemed to be the entrant. An “authorized account holder” is defined as the natural person who is assigned to the Instagram or Facebook Account by Instagram or Facebook at the time of entry.
5. WINNER SELECTION/NOTIFICATION AND ODDS OF WINNING: Potential winners will be selected in a random drawing to be held on or about Wednesday, June 14, 2017 from all valid entries received. The odds of winning depend on the number of eligible entries received. Potential Prize Winners will be notified through Instagram or Facebook private message functionality within 2-3 business days following the prize drawing (to be held on or about June 14, 2017) and will be asked to send an Instagram Direct Message OR Facebook Direct Message to BIC Razor with their date of birth, country of residence, full name, mailing address (no P.O. Boxes permitted) and email address to confirm their winner status and officially accept the prize. Potential winners will be notified via the social media platform they used to enter the Sweepstakes. Once received, Administrator will send a reply via the BIC Razor Instagram or Facebook account to the Potential Winner confirming their winner status and will fulfill the prize after confirmation. Prize will be shipped to confirmed winner (U.S. addresses only, no P.O. Boxes permitted) via UPS or comparable carrier within 4-6 weeks. Potential Winner must respond to the initial Instagram or Facebook direct message notification within three (3) business days, otherwise prize will be forfeited. If a potential Prize Winner is found to be ineligible or not in compliance with these Official Rules, declines to accept the prize, fails timely to respond to the notification post, if the notification that the Sponsor sends is returned as undeliverable, or the potential Prize Winner is otherwise unreachable for any reason for a period of three (3) business days following first attempted notification, the prize will be forfeited. If prize is forfeited, an alternate Prize Winner may be randomly selected from the remaining valid entries and confirmed in accordance with these Official Rules. By accepting a Prize, Prize Winner represents that they have complied with these Official Rules.
Entry and acceptance of prize offered constitutes permission for Sponsor to use Prize Winner’s name, city, state of residence, likeness and/or photograph and statements for advertising/trade and all other purposes, in any and all media, and all media now or hereafter known worldwide in perpetuity, including the Internet and social networking sites, without further compensation, notification or permission, unless prohibited by law.
6. CONDITIONS OF PARTICIPATION: Sponsor will collect information from the Eligible Participant solely for the purpose of administering the Sweepstakes and prize fulfillment. Sponsor’s use of information submitted by Eligible Participants in connection with this Sweepstakes will be subject to the terms and conditions stated in these Official Rules as well as to the Sponsor’s Privacy Policy available at http://bicflexrazors.com/#policy. To the extent of any conflict between these Official Rules and the Sponsor’s Privacy Policy, these Official Rules shall govern.
7. REPRESENTATIONS AND WARRANTIES: Eligible Participants represent and warrant the following: 1) that he/she is the original author and sole owner of or has rights to any and all Entry materials posted, uploaded, or otherwise submitted; 2) the Entry will not, in Sponsor’s sole discretion, infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or violates any third party rights of publicity or privacy; 3) that the Entry is not the subject of any actual or threatened litigation or claim; and 4) that the Entry material is not obscene, offensive, libelous, pornographic, threatening, abusive, contains illegal content, or is otherwise objectionable, as determined by the Sponsor, that would constitute or encourage a criminal offense, or that would otherwise give rise to liability or violate any law.
8. LIMITED LIABILITY: If by reason of a computer or other error, more promotion prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded. Unclaimed prizes will not be awarded. Although subsequent attempts to enter may be received on any day, only the first Entry received from a particular individual will count. Entries may only be made according to the methods described above. Every Entry must be manually key-stroked by entrant. Automated entries (including but not limited to entries submitted using any bot, script, macro, or promotion service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified.
9. GENERAL CONDITIONS: Sponsor, Administrator, Warner Nashville, Rudy’s, Facebook, Instagram, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, delayed, misdirected, illegible, garbled or damaged entries, prize claims, email or mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries or prize claims, the announcement of the prizes or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer or mobile/tablet device related to or resulting from participating in this Sweepstakes. Persons who tamper with or abuse any aspect of the Sweepstakes or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. If for any reason the Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, extensive negative publicity or media attention, technical failures, or any other causes beyond the control of the Sponsor, which corrupts or affects the administration or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Sweepstakes or any element thereof. Sponsor reserves the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). Notice of such cancellation, modification, or suspension will be posted on the BIC Razor Instagram and BIC Razor Facebook accounts. If terminated for any reason at any time prior to the end of the Sweepstakes Period, Sponsor may, at its discretion, award the Prize Winner from among all non-suspect, valid, eligible entries received up to time of such action in a random drawing. If a technical failure or disturbance occurs and entry is terminated midway through or at any time prior to the end of the Sweepstakes Period, all non-suspect, valid, eligible entries received through that point will be included in a random drawing for the Sweepstakes Prize. Entrants, by participating, agree that Released Parties will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of Prize or participation in this Sweepstakes.
10. DISPUTES: This Sweepstakes is governed by the laws of the United States and the State of Connecticut, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Connecticut having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
